Supreme Court will hear pleas on CEC Gyanesh Kumar

The Supreme Court will hear on Monday two petitions questioning Chief Election Commissioner Gyanesh Kumar, The Indian Express reported on 5 October 2026.

The petitions call for an SIT probe against him and others and ask the court to declare the nationwide special intensive revision of electoral rolls illegal. A bench of Chief Justice Surya Kant and Justices Joymalya Bagchi and V. Mohana will hear the matter.

Gyanesh Kumar petitions follow commissioners’ objections

The Indian Express said the petitions were filed days after it reported that Election Commissioners Sukhbir Singh Sandhu and Vivek Joshi had recorded objections at least 14 times over the past 10 months to decisions and orders on the revision. The two commissioners said some decisions were issued without their knowledge or recommendation. They separately wrote to Cabinet Secretary T. V. Somanathan, flagging concerns over the integrity of voter software.

The Election Commission said those letters concerned an officer on deputation and were not related to policy or the IT division. One petition, by Patna resident Rakesh Kumar Singh, refers to the alleged differences and to the objections. “Article 324(1) of the Constitution does not vest the superintendence, direction and control of elections in an individual Chief Election Commissioner. It vests those powers in a Commission,” the plea said.

He argued that the text separates membership from chairmanship, and chairmanship from the Commission’s power. His grievance, he said, is not that Kumar used the chief’s powers improperly, “but that he has… held out as entitled to exercise” the collective authority under Article 324 and Section 18 of the Chief Election Commissioner and Other Election Commissioners Act, 2023, “to which Article 324(3) gives him no individual title”.

Singh asked the court to declare the revision, and all actions, decisions, directions and measures under it, invalid from the beginning and without legal authority.
