OpenAI brings ChatGPT text watermark to the EU under AI Act

OpenAI said on Monday, 5 October 2026, that it will add an invisible ChatGPT text watermark to text generated by ChatGPT and Codex in the European Union, to comply with the EU AI Act, TechCrunch reported. The company said the change will roll out over the coming weeks to eligible users on all plans, but only in the EU.

How the textGrain watermark works

The technology, called textGrain, does not add a visible symbol. Instead, it subtly shapes the model’s word choices, leaving a statistical pattern that readers cannot see but a detector can find. OpenAI’s help page says it adds no hidden characters, invisible spaces or unusual punctuation. Because the signal lives in the wording, it travels with the text when it is copied and pasted.

OpenAI said the ChatGPT text watermark does not identify the user and that it saw no meaningful change in model performance with it turned on. A technical report dated 5 October sets out the maths behind the method.

Opt-in for developers worldwide

Developers using OpenAI’s API anywhere in the world can switch on watermarking for select models from Monday. The setting is off by default, and OpenAI said it is not making text watermarking a global default at launch. In a developer forum post, the company said detector access will initially be limited to approved researchers and expert organisations, because short passages and later edits make detection less reliable.

OpenAI also cautioned that a missing watermark “does not prove human authorship”. The text could be too short or heavily edited, or it could come from another company’s AI. The watermark also cannot show who used the system, how much a person contributed, who owns the text, or whether the content is accurate.

Why the EU rules matter

The EU AI Act’s transparency rules took effect on 2 August and require AI companies to mark AI-generated content in a way other systems can identify. Anthropic, Google, Meta, Microsoft and OpenAI are among the companies that have committed to follow the EU’s code of practice on AI-generated content, TechCrunch said. Bloomberg Law also reported the move on 5 October, noting that API customers globally can opt in from the same day.
