SC refuses interim stay on UPI MDR; asks Centre and RBI to explain levy

The Supreme Court has refused to grant an interim stay on the proposed merchant discount rate (MDR) for eligible UPI transactions, while asking the Centre and the Reserve Bank of India to explain the statutory source and executive scope of the levy. The order keeps the policy path open for charges on certain UPI payments above a threshold, even as petitioners warned of a hit to India’s low-cost digital payments boom.

What the court left undecided — for now

Bench observations made clear that refusing a stay is not a final verdict on legality. Judges want the government and RBI to place on record how the MDR framework sits within payment-system law, who may notify rates, and how consumer and small-merchant interests were weighed. Industry notes have pointed to a possible October window for applying MDR on eligible transfers above ₹2,000, though operational circulars and exempt categories will decide the real-world impact.

UPI processed well over 14 billion transactions in a recent month, and any friction at the merchant edge matters for kirana digitisation, QR acceptance and fintech unit economics. The debate overlaps Apple Pay’s Axis-only India launch — see our Apple Pay report — because card rails already carry MDR while UPI grew on a zero-MDR promise for many use-cases.

Stakeholders line up

Merchant bodies fear fee pass-through; banks and payment firms argue sustainable economics after years of free rails. Coverage of the stay refusal is in The Times of India.

Fintech lobby notes circulating in Delhi argue that a sudden MDR reboot without clear MSME exemptions could slow QR adoption in Tier-3 towns just as festive merchant volumes peak.

Watch list

RBI’s affidavit, any revised threshold or MSME carve-outs, and NPCI operational guidance will set the next chapter before festive-season volumes peak.
