Supreme Court shuts 23-year-old legislative privilege case in under half an hour

A seven-judge Constitution Bench of the Supreme Court, headed by Chief Justice of India Surya Kant, on Tuesday, 6 October 2026, disposed of a legislative privilege case that had been pending in New Delhi for over two decades. The bench called the reference infructuous because the 2003 Tamil Nadu Assembly resolution that triggered it had been withdrawn in 2004.

Why the legislative privilege case was closed

Senior advocate Raju Ramachandran, appearing for the Tamil Nadu Legislative Assembly, told the court that the resolution against The Hindu had been withdrawn. He had first flagged this on Monday, 5 October, the eve of the hearing, with the backing of Attorney General R. Venkataramani and Solicitor General Tushar Mehta. The bench noted that the withdrawal had escaped the court’s notice when the matter was sent to seven judges in August.

The bench also included Justices Aravind Kumar, P.K. Mishra, Joymalya Bagchi, Vipul Pancholi, Shree Chandrashekhar and V. Mohana. The hearing took less than half an hour. Senior advocate A.M. Singhvi remarked that the court had set two records: the shortest hearing and the quickest one by a seven-judge bench.

How the case began in 2003

The dispute dates back to an editorial in The Hindu that criticised then Chief Minister Jayalalithaa. The Assembly passed a resolution saying the editorial amounted to a breach of the privileges of the entire House under Article 194 of the Constitution, and ordered the arrest of the newspaper’s editorial staff. Police then raided The Hindu’s Chennai office.

N. Ravi, then Editor of The Hindu, approached the Supreme Court in November 2003. On 8 December 2003, a Division Bench of Justices Y.K. Sabharwal and B.N. Krishna referred the clash between legislative privilege and free speech to a five-judge Constitution Bench, and the matter later went to a larger bench.

Big questions left open

At the petitioners’ suggestion, the court left the larger questions of law open for a future case in which such a conflict arises again. These include how Article 194(3), which deals with the powers and privileges of state legislatures, interacts with the right to free speech under Article 19(1)(a) and the right to life and liberty under Article 21. Earlier hearings had pointed to conflicting views in a 1959 judgment and a 1964 Presidential Reference.
